IV. SAFETY

ELNEO CANADA employs a number of technical, physical and organizational security measures to ensure data integrity, confidentiality and availability. ELNEO CANADA has implemented security techniques to protect stored data from unauthorized access, improper use, alteration, unlawful or accidental destruction, and accidental loss. Only ELNEO CANADA employees have access to personal data, and then only to the extent necessary to perform their duties. These employees are bound by the duty to respect privacy and to treat as confidential any personal data of which they are aware. Their use is strictly limited to the performance of the tasks entrusted to them.

ELNEO CANADA may be obliged to disclose certain data to third parties in order to protect its legal rights or if a legal obligation makes it necessary to communicate such data to the authorities or following a judicial decision.

V. DATA RETENTION PERIOD

ELNEO CANADA will not retain personal data beyond the time necessary to fulfill the purpose for which it was collected. However, in order to comply with its legal, accounting and tax obligations, ELNEO CANADA must retain billing data for 7 years. ELNEO CANADA will keep, by legal necessity, certain data (contract, invoices, correspondence) as evidence in case of litigation, up to 10 years after termination of the contract. At the end of the applicable retention periods, personal data will be deleted or rendered anonymous.

VI. RIGHTS CONCERNING THE PROCESSING OF PERSONAL DATA

At any time, you have the right to:

  • Consult your personal data processed by ELNEO CANADA. You have the right to know the purposes for which they are processed, the recipients, the retention period or the criteria for determining the period, and the existence of an automated decision-making process. ELNEO CANADA will provide this information in an understandable form.
  • Have your incomplete, erroneous, inadequate or obsolete personal data corrected
  • Under certain circumstances, your personal data may be deleted immediately if one of the following situations arises. However, data need not be deleted if processing is necessary to comply with a legal obligation of ELNEO CANADA or to establish, exercise or defend a legal claim:
    • The data are no longer necessary for the purposes for which they were collected or processed
    • You withdraw your consent to the processing and there is no other legal basis that ELNEO CANADA can invoke to (continue) the processing
    • You object to the processing of personal data and there is no justified basis for ELNEO CANADA to continue the processing
    • Your personal data is processed unlawfully
    • A legal obligation must be met
    • Your personal data was collected while you were still a minor.
  • Limit the processing of personal data concerning you, when :
    • The accuracy of personal data is disputed
    • The processing is unlawful
    • ELNEO CANADA no longer needs the personal data for the original purposes of processing but you need it for the establishment, exercise or defence of legal claims.
    • As long as no decision has been taken concerning the exercise of your right to object to processing.
  • Request ELNEO CANADA to retrieve your personal data. This is only possible for data that you yourself have provided to ELNEO CANADA on the basis of an authorization or a contract. You can ask ELNEO CANADA to recover the data concerned in a structured format, commonly used, readable and exploitable by a person or a computer software or to transmit them directly to another data controller.
  • Object, by virtue of your particular circumstances, to the processing of your personal data if the processing is in ELNEO CANADA's legitimate interest or in the public interest. ELNEO CANADA will suspend the processing of the data concerned, unless ELNEO CANADA can demonstrate that there are compelling legitimate grounds for the processing which override yours, or if the processing of the data is connected with the establishment, exercise or defence of legal claims. Where personal data is processed for canvassing and direct marketing purposes, you have the right to object at any time to the processing of your personal data for such canvassing purposes.

You may exercise your privacy rights free of charge, unless your request is manifestly unfounded or exaggerated. In this case, ELNEO CANADA has the right and the choice either to charge you a reasonable compensation based on the administrative costs incurred, or to refuse to comply with your request. ELNEO CANADA will respond to your request as soon as possible, and in any event within one month of receipt of your request. However, this period may be extended by two months depending on the complexity and number of requests. In the event of an extension, ELNEO CANADA will inform you within one month of receipt of your request. If ELNEO CANADA does not comply with your request, ELNEO CANADA will inform you of the possibility of lodging a complaint with a supervisory authority and of appealing to a judge.
